The name Brock Turner will, unfortunately, be forever etched into our minds. Not because he did something for the good of humanity, but because did something extremely atrocious. In January 2015, Turner infamously raped and assaulted an unconscious woman behind a dumpster at a party. He faced up to 14 years in prison, but only received a six-month sentence, and ended up serving only THREE MONTHS.
On Friday, December 1st, Turner's legal team filed a 172-page appeal on his behalf. While his case was very clearly a rape case, Turner was not convicted of rape, but just three felony counts of sexual assault. And now his camp wants it all overturned.
"What we are saying is that what happened is not a crime," John Tompkins, Turner's legal adviser, told NBC. "It happened, but it was not anywhere close to a crime."
Not a crime? I'm sorry, what?
Oh, and they also vehemently argue that the deputy district attorney was unfairly prejudiced against Turner, due to the recurrent use of the phrase, "behind a dumpster," throughout the trial. His lawyers are debating that the depiction of the crime "implied an intent on the appellant's part to shield and sequester his activities" and "implied moral depravity, callousness, and culpability on the appellant's part because of the inherent connotations of filth, garbage, detritus and criminal activity frequently associated with dumpsters." Seriously? This is a stretch, even for a garbage human.
This appeal comes a year after Turner was released from jail. Even though he already served his time, he must register for life as a sex offender, which he is. This is probably the reason for this absurd call to overturn the conviction.
Santa Clara County District Attorney Jeff Rosen believes that this legal battle is a lost cause, according to a statement he gave to The Mercury News.
"Brock Turner received a fair trial and was justly convicted. His conviction will be upheld. Nothing can ever roll back Emily Doe’s legacy of raising the world’s awareness about sexual assault."
In other words, not today, Satan.
